2014年底,国务院颁布了《国务院关于创新重点领域投融资机制,鼓励社会投资的指导意见》。这一行为意味着PPP模式也由过去20多年处于自由无序的发展层面正式走向国家的宏观发展计划之中。而PPP模式的相关现行法律呈现的分散化、碎片化布局使得PPP模式在推广和运行时遇到了法律空白与法律冲突等多重的现实阻碍。积极推动我国PPP模式由现行的分散立法走向统一立法,形成统一的PPP立法模式方能积极应对并解决这一现实阻碍。
By the end of 2014, the State Council promulgated the “Guiding Opinion of the State Council on Innovating Investment and Financing Mechanism in Key Fields and Encouraging Social Investment.” This act means that the PPP model has also been officially headed by the macro-development plan of the country by the free and disorderly development over the past 20 years or so. However, the decentralized and fragmented layout of the existing relevant laws of PPP mode makes the PPP model encounter multiple real obstacles such as the legal blanket and legal conflicts in the promotion and operation. Actively promote China’s PPP model from the current decentralized legislation to unify legislation, the formation of a unified PPP legislative model can actively cope with and solve this practical obstacles.
