在全面推进依法治国语境下,我国现行宪法实施仍存在法律属性功能障碍、监督保障职能弱化、“社会养分”不足等问题。解决方法可以是:强化宪法监督,对违宪行为加强审查并处置;积极推动依宪释法,增强宪法作为法律属性的法律适用功能;深入开展以宪法宣誓为轴心的宪法宣传,引导社会形成学宪法、用宪法、遵宪法的良好氛围。宪法监督、依宪释法和以宪法宣誓为轴心的宣传制度对于规范公权力运行,保障公民合法权益,维护宪法权威具有重要意义。
In the overall promotion of the context of governing the country according to law, the implementation of the current constitutional law in our country still lags behind such issues as dysfunction of legal attributes, oversight and protection of weakening of functions and lack of social nutrition. The solution may be: to strengthen the supervision of the constitution, to strengthen the review and disposal of unconstitutional acts; to actively promote the constitutional interpretation of the Constitution and enhance the legal function of the constitution as a legal attribute; to carry out the constitutional promotion centered on the constitutional oath and guide the social formation study Constitution, the constitution, the good atmosphere of constitutional law. Constitutional supervision, the Constitutional Interpretation Act and the constitutional oath as the center of the publicity system for regulating the operation of public power to protect the legitimate rights and interests of citizens, to safeguard the constitutional authority of great significance.
