生物科技已经成为世界各国的一个新增长点,生物遗传资源作为生物科技的重要材料,不管在发达国家还是发展中国家都得到高度重视。面对竞争如此激烈的领域,《生物多样性公约》对遗传资源财产权作了特别的规定。本文根据《生物多样性公约》的精神,对生物遗传资源的价值以及生物遗传资源的利益分享权的含义进行阐述,与传统财产权及特殊权利进行比较,分析其中的共性以及生物遗传资源利益分享权的特殊性所在。
Biotechnology has become a new growth point for all countries in the world.
