从法定的可适用于图书馆的著作权例外、从图书馆面临的数字化网络化环境和从图书馆当前的资源建设与信息服务等三个角度,分析从图书馆可适用的著作权例外角度规避著作权侵权风险的可行性。在此基础上,将我国图书馆规避著作权侵权风险的对策建议分为两大方面。一是严格遵循并充分利用可适用于图书馆的著作权例外,包括:图书馆从复制权例外角度开展数字资源长期保存的对策;图书馆从信息网络传播权例外角度规避著作权侵权风险的对策;图书馆从技术措施规避例外角度规避著作权侵权风险的对策;充分利用可适用于图书馆的声明性著作权例外的对策。二是不作被动地等待,而是主动参与、积极宣传和专门跟踪。包括:积极反映著作权例外立法诉求,参与立法活动;加强可适用于图书馆的著作权例外的宣传推广;设置著作权研究部门或专职研究岗位。
From the statutory copyright exceptions applicable to the library, this paper analyzes the copyright infringement from the perspective of the applicable copyright of the library from three aspects: the digitalized network environment the library faces and the current resource construction and information service of the library Feasibility of risk. Including: Actively reflect the copyright exceptions to the legislative demands, to participate in legislative activities; to strengthen the copyright applicable to libraries of the publicity and promotion; set the copyright research department or full-time research positions.
