自卫权是《联合国宪章》赋予国家的一项固有权利,但针对自卫权的一些具体内容仍存在较大的争议。本文从《联合国宪章》第51条入手,重点分析了非国家行为的武力攻击是否应由第51条调整以及国家是否拥有预防性自卫权两个问题,并提出笔者对于解决这两个法律问题的建议。对这些问题的探究有利于我们更充分的理解自卫权,以及促进自卫权相关法律内容的完善。
The right to self-defense is an inherent right vested in the United Nations by the UN Charter. However, there are still some major controversies regarding some specific contents of the right to self-defense. Starting with Article 51 of the “UN Charter,” this article focuses on two issues: whether the armed attack on non-state acts should be adjusted by Article 51 and whether the state has the right of preventive self-defense. It also points out that the author has a strong interest in resolving these two legal issues Suggest. Exploring these issues will help us to better understand the right of self-defense and to improve the legal content of the right to self-defense.
