案例:陈某,男,43岁,连续工龄26年,系广州市某国有机器厂固定工。1990年2月起因类风湿性关节炎,双手每个指间关节活动功能受限,并患有慢性迁延性肝炎而长期病休吃劳保迄今。1994年8月,单位接上级部门要求,要在全厂推行全员劳动合同制,为此,单位要求陈某也应签订劳动合同。但陈某对此不甚理解,既然单位已批准其长期病休,为何还要签订劳动合同。专家评析:劳动部劳部发〔1995〕202号“关于印发(实施<劳动法>中有关劳动合同问题的解答)的通知”规定:“企业中长期病体、放长假和提前退养的职工(注:固定工),仍是企业职工,与用人单位
