罚款,犹“罚锾”。意为纳金赎罪,《辞海》将其界定为:“(1)审判机关强制罪犯缴纳一定金额的一种刑罚;(2)行政机关强制违犯行政法规的人缴纳一定金额的一种行政处罚;(3)违约金的一种。违反合同、延迟履行义务的一方,按照合同规定赔偿对方的款项。”然而,近些年来,罚款一词已突破了原有词义的界定。它远远地超出了上述3个领域,而演变成为各行各业维护其秩序或规章与规范的“法宝”和“武器”。各种名目的“罚款规定”见诸文字,令人目不暇接,已成为司空见惯的现象。
