目的:为完善药品监督行政执法程序,提高行政执法效率提供参考。方法:对我国药品监督行政处罚程序期限不明的弊端进行分析,通过文献综述总结诉讼制度中关于举证期限的规定,借以对药品监督行政处罚案件调查取证举证期限和举证责任分配提出建议。结果与结论:调查取证举证期限和举证责任分配成为药品监督行政处罚案件办理的限速步骤。通过借鉴我国三大诉讼制度关于举证期限等的规定,建议药品监督行政处罚案件办理中调查取证举证期限及举证责任划分可根据现有的行政处罚案件分类分级制度分别作出设定,明确举证期限的确定部门、期限延长程序及逾期提供证据的法律后果,明确监管部门和相对人举证责任的划分。
Objective: To provide reference for improving the administrative law enforcement procedure of drug supervision and improving the efficiency of administrative law enforcement. Methods: Analyze the malpractice of drug supervision and administrative punishment procedures in our country, summarize the provisions of the litigation system about the period of evidence in the litigation system, and put forward suggestions on the investigation of the evidence collection period and the burden of proof in drug supervision and administrative penalty cases. RESULTS AND CONCLUSION: The investigation of evidence collection period and the burden of proof have become the speed-limiting steps for drug supervision and administrative punishment cases. By referring to the provisions of the three major litigation systems in China on the period of proof, it is suggested that the period of evidence-based evidence-gathering and the division of burden of proof in the handling of administrative penalty cases in pharmaceutical supervision should be set separately according to the existing system of classification and grading of administrative penalty cases, Determine the department, the deadline for the extension of the process and the legal consequences of providing evidence overdue, clear the regulatory authorities and relatives of the burden of proof.
