大数据时代下,对数据、信息的概念及其相互之间关系的明确具有重要的法学研究价值。这种价值不仅仅是在概念的明晰上,更重要的是通过对数据、信息在大数据时代的再认识,结合数据、信息本身在大数据周期中“关系化”的过程,来探讨在数据信息资源之上赋予财产性权利的正当性问题。数据在大数据生命周期中转化为信息,信息在新一轮的大数据生命周期中作为数据进行转化,成为新的信息。数据不断的“关系化”为信息的过程,是数据使用价值提升的过程,而提升数据的使用价值,是大数据时代价值流转的根本原因。促进数据开放的同时,对能够提升数据使用价值的市场主体赋予一定的财产性补偿,是大数据时代平衡个体利益与公共利益的唯一路径。
Under the era of big data, the concept of data and information and the relationship between them clearly have important legal research value.
