在经济迅猛发展和村民法律意识逐渐增强的今天,受市场经济和中国传统文化双重矛盾影响的转化型农村民事纠纷问题日益突出。在和解和调解占主导地位的纠纷解决机制下,本文在分析农民纠纷解决方式选择原因的基础上,从国家、社会、个人三方面,力图构建一个以法治为主导的民事纠纷解决机制。 Today, with the rapid economic development and gradual increase of villagers’ legal awareness, the issue of civil disputes in the transitional rural areas under the dual contradictions of the market economy and Chinese traditional culture has become increasingly prominent. Under the dispute settlement mechanism dominated by reconciliation and mediation, based on the analysis of the reasons for the choice of peasants’ dispute resolution methods, this paper attempts to build a civil dispute resolution mechanism dominated by the rule of law from the aspects of country, society and individual.
