养老权是国家赋予劳动者的基本权利之一,是劳动者在年老丧失劳动能力时享受国家所提供的物质帮助的权利,不容任何人、任何单位组织侵犯。目前我国实行的是社会统筹与个人账户相结合的养老保险制度,用人单位为劳动者缴纳养老保险费的早与晚、缴费基数的高与低、缴纳的时间长与短等,都直接影响到劳动者退休后养老金的多少。但是从目前情况看,用人单位拖欠养老保险费、降低缴费工资等侵犯劳动者养老权的现象十分严重,究其原因,劳动者本身的“不作为”也是用人单位侵权的原因之一。有相当一部分劳动者只顾埋头干活,对养老保险情况不闻不问,不知道自己的缴费工资,不知道单位是否按时足额为自己缴费,认为这些都与己无关;有的只是在退休后
