2013年1月1日,经全国人大常委会新修改《中华人民共和国民事诉讼法》已正式施行,新法为适应经济社会发展的需要和深化司法体制改革的要求,进行了较大的修改,具有不少亮点。其中新增条款第133条作为亮点之一着重体现了司法高效的诉讼原则。该条款规定法院有权依据受理案件所涉纠纷类型的不同,在立案阶段分别予以不同处理方式,旨在节约司法资源,提高司法效率。本文则对该条款项下规定的多元纠纷处理方式提出价值和适用上的质疑,认为该条款与新民诉法中关于限缩法官裁量权,增加当事人的主体地位和程序权利的价值取向存在矛盾。若不加以具体化的适用解释,对当事人程序权利的行使存在不利影响,有违我国民事诉讼法的立法宗旨。
On January 1, 2013, the Civil Procedure Law of the People’s Republic of China was officially amended by the NPC Standing Committee’s new amendment to the Civil Procedure Law of the People’s Republic of China. The new law has made great changes to adapt to the needs of economic and social development and deepen the reform of the judicial system, Many bright spots. Among them, Article 133 of the new clause highlights one of the highlights of the judicial principle of efficient litigation. The article stipulates that the court shall have the power to treat the case differently depending on the type of disputes involved and separately handle the case at the stage of filing separately in order to save the judicial resources and enhance judicial efficiency. This article puts forward the value and application of the multiple dispute resolution methods stipulated in the article. It considers that this article contradicts with the value orientation of restricting the discretion of judges and increasing the subject status of the parties and procedural rights in the New Civil Procedure Law. Without the application of specific explanations, there is an adverse effect on the exercise of the procedural rights of the parties, which is against the legislative purpose of the Civil Procedure Law of our country.
