消费者及媒体对商品、服务有权批评、评论,但借机诽谤、侮辱则构成对法人名誉权的侵害。消费者及媒体的事实陈述应基本属实,媒体应承担合理查证义务;消费者及媒体的意见表达应合理评论,评论空间应尽量宽广,法人应适当容忍。在言论自由与法人名誉权保护中,总体上应体现弱者保护的司法理念。
Consumers and the media have the right to criticize and comment on the goods and services, but taking the opportunity to defame and insult constitute the infringement on the reputation of legal persons. Consumer and media factual statements should be basically true, the media should assume reasonable obligations to verify; consumers and the media opinion should be reasonable comments, comment space should be as broad as possible, corporate should be properly tolerated. In the freedom of speech and the protection of legal person’s reputation, the judicial concept of the protection of the weak should be generally reflected.
