在目前的司法实践中,职务犯罪案件量刑中不均衡、不适当,甚至量刑畸轻畸重的情况时有发生,严重影响了司法机关惩治职务犯罪工作的声威。本文从职务犯罪量刑的实证分析入手,对当前职务犯罪案件中的量刑问题进行综合分析,并对问题的解决提出一己之见。
In current judicial practice, the cases of job-related crimes are disproportionately and inappropriately sentential, and even the cases of excessive severity of sentencing occur frequently, seriously affecting the reputation of judicial organs in punishing job-related crimes. This article starts with the empirical analysis of the sentencing of duty crime, and makes a comprehensive analysis of the sentencing problem in the current duty crime case and puts forward my own opinion on the solution of the problem.
