根据相关司法解释的规定,所谓在公共交通工具上抢劫,是指在从事旅客运输的各种公共汽车,大、中型出租车,火车,船只,飞机等正在运营中的机动公共交通工具上对旅客、司乘人员实施的抢劫,包括对运营途中的机动公共交通工具加以拦截后,对公共交通工具上的司乘人员实施抢劫。《最高人民法院关于抢劫、抢夺刑事案件适用法律若干问题的意见》(以下简称《两抢》)中又对此作出补充,即在未运营中的大、中型公共交通工具上针对司售、乘务人员抢劫的,或者在小型出租车上抢劫的,不属于“在公共交通工具上抢劫”。司法实践中,涉及公共交通工具上抢劫的案件较常见,其中的一些争议也颇多。
