人才流动是促进经济快速发展的重要资源整合方式,然而放任人才的肆意流动又会产生企业商业秘密流失的危害。我国法律既保护劳动者的劳动权和择业自由权,也保护企业的商业秘密权,两者平衡下竞业限制制度便成为法制领域不容回避的问题。本文即对竞业限制制度及相关问题进行简要分析。
Talent mobility is an important resource for the rapid economic development. However, the arbitrary flow of letting go of professionals can endanger the loss of business secrets. The law of our country not only protects the laborer’s right to work and freedom of employment, but also protects the right of commercial secrets of the enterprise. Under the balance of the two, the system of restriction of competition has become an unavoidable issue in the area of legal system. This article is a brief analysis of the non-compete system and related issues.
