系统梳理我国矿产资源开发监管领域中主要的政府协同实践形式,分析这些协同形式存在的问题,并在此基础上研究优化协同治理的总体框架和具体目标,以期为我国矿产资源开发监管政策的完善和发展提供参考建议。联席会议、联合执法和联合发文是矿产资源开发监管领域中的3种主要的政府协同机制。在该领域中,政府协同行为缺乏法律保障,协同流程不健全,协同机制自身存在缺陷,部门利益和地方利益的存在增加了协同的不确定性。为了提高矿产资源开发监管政府协同治理的整体效能,需要授予政府自由裁量权并加以监督,科学界定部门职能,建立自上而下和自下而上相结合的政府协同问责机制,并在完善现有协同机制的基础上多措并举。
Systematically combing the main form of government collaborative practice in the regulation of mineral resources development in our country, analyzing the problems existing in these forms of cooperation and on the basis of this study, studying the overall framework and specific objectives of optimizing collaborative governance in order to improve the regulatory policies for the development of mineral resources in China And development to provide reference. In this field, the lack of legal protection of government coordination behavior, the synergistic process is not perfect, the coordination mechanism itself has flaws, the existence of departmental interests and local interests increase the synergetic uncertainty. In order to improve the overall efficiency of government coordination and development in mineral resources development, it is necessary to grant the government discretionary power and supervise it, to scientifically define departmental functions, establish a top-down and bottom-up government coordination and accountability mechanism, On the basis of the existing synergies, we should take a drastic measure.
