刑法中的普遍管辖原则是指,对于犯罪人,不论他具有何国国籍或在何处犯罪,也不论他的行为侵犯了哪国利益,只要他的行为危害了国际社会所维护的正常秩序,各国均可行使刑事管辖权,对他的罪行适用有关国际条约或本国法进行审判和处罚。普遍管辖理论的产生同殖民主义和帝国主义的扩张要求不无联系,社会主义国家的法学家们曾一度批判过这个理论,指出它是帝国主义国家否认体现一个国家主权的属地原则、属人原则、保护原则而强迫其它国家按其自己的意志、利益去制裁犯罪分子的霸权主义。但是,
