信用卡是银行或有关机构发给资信较好的公司或有稳定收入的个人,用于在指定商家购物和消费、或在指定银行机构存取现金的信用凭证。全国人大常委会2004年、2005年先后颁布的《关于〈刑法〉有关信用卡规定的解释》和《刑法修正案(五)》,对于刑法意义上的“信用卡”作了明确界定,并补充了数种信用卡犯罪的行为模式,为有效打击和预防日益猖獗的信用卡犯罪提供了更为具体的法律依据。本文对恶意透支型信用卡诈骗犯罪的一些相关问题进行了探析。
A credit card is a credit card issued by a bank or a related agency to a company with good creditworthiness or a stable income, a voucher for cashing or credit at a designated merchant for shopping and spending, or at a designated banking institution. The Explanations on Credit Card Regulations and Criminal Law Amendment (5) promulgated by the Standing Committee of the National People’s Congress in 2004 and 2005 have clearly defined the “credit card” in the criminal law and added that The behavior patterns of several kinds of credit card crimes provide a more specific legal basis for effectively cracking down on and preventing the increasingly rampant credit card crimes. This article probes into some related issues of the crime of malicious overdraft credit card fraud.
