刑法国际化与欧洲化的加剧使比较法和刑事科学产生了全面的变化。由于欧洲刑法和国际刑法的出现,以及欧洲和全球法律规范与国家法律秩序之间的互动,对法律秩序进行比较研究已成当务之急。同时也不应忽略犯罪学与刑事司法比较研究的重要性。研究机构的成果应能适用于不同国家,为此须提高研究成果的实用价值与决策适用性。刑事政策的规划需要更多的犯罪学循证研究,并以此作为理性刑事政策的基础。这对于欧盟刑事政策的决策与决策者尤为重要,因其刑事政策的制定尚未建立在相同的理念和相关犯罪学研究基础之上。比较刑法学家们面临的一个极具挑战的问题是:对于刑法总论部分,也就是一般法律原则与概念,我们能说它获得了何种程度的共同法律立场?刑法某些领域的多样性——特别是日趋欧洲化的经济刑法与日趋国际化的人道主义法律——反映了通用法律学说的多元主义。现在亟须发展出一种更加动态的概念化和系统化的思想,来控制众多平行的法律规范及其调整对象的多样性。传统刑法的某些概念与原则的变化具有充分的刑事政策理由,以便将宏观犯罪和所谓的有组织犯罪的本质考虑在内。与此同时,必须对功利目的与被追诉人的基本权利和自由进行平衡。
The globalization of criminal law and the intensification of Europeanization have brought about an overall change in comparative law and criminal science. Due to the emergence of European criminal law and international criminal law, as well as the interaction between European and global legal norms and the national legal order, a comparative study of the legal order has become a top priority. At the same time, we should not neglect the importance of the comparative study of criminology and criminal justice. The results of research institutes should be applicable to different countries. Therefore, the practical value of research results and the applicability of decision-making should be improved. The planning of criminal policy needs more criminal evidence-based research and uses it as the basis of rational criminal policy. This is particularly important for decision-makers and policy-makers in the criminal policy of the European Union because their criminal policy has not yet been established on the same basis and on the basis of related criminological studies. A very challenging question to compare criminal lawyers is: To what extent can we say that the common law position and the diversity of legal fields we can claim about the general part of the criminal law? - especially the increasingly Europeanized economic criminal law and the increasingly internationalized humanitarian law - reflect the pluralism of the general legal doctrine. There is an urgent need to develop a more dynamic concept of conceptualization and systematic thinking to control many parallel legal norms and the diversity of their object of adjustment. Changes in certain concepts and principles of traditional criminal law have ample criminal policy grounds to take into account the nature of macrocentric crimes and so-called organized crime. At the same time, we must balance the utilitarian purpose with the basic rights and freedoms of the person sought.
