随着市场经济的深入发展,经营者滥用相对优势地位的情况却越来越多,直接破坏了自由、公平的竞争坏境,最终损害了广大消费者的合法利益。因此,我国反垄断法应当对滥用相对优势地位的行为进行明确的规定,使其得到有效的规制。本文通过分析相对优势地位理论以及对其规制的必要性,提出完善该规制制度的建议。 With the further development of the market economy, the abuse of the comparative advantage by operators is more and more, directly undermining the free and fair competitive environment and ultimately undermining the legitimate interests of consumers. Therefore, our country’s antitrust law should clearly stipulate the behavior of abusing the relative superiority status so that it can be effectively regulated. By analyzing the theory of relative superiority status and the necessity of its regulation, this paper puts forward the suggestion of perfecting the regulation system.
