信托是委托人、受托人和受益人之间基于特定财产的持有、管理(投资运营)和收益分配而发生的社会关系。受托人按照委托人的意愿以自己的名义,为受益人的利益或特定的目的,对信托财产进行管理或处分。信托的主要法律特征可以概括为:一是信托义务具有强制性。受托人只能按照信托文件的条款和法律规定实现委托人的意愿和要求,为受益人的利益最大化服务。二是信托财产具有独立性。信托关系一经成立,信托财产就从委托人、受托人和受益人的财产中独立出来。
A trust is a social relationship between the principal, the trustee and the beneficiary based on the possession, management (investment operation) and distribution of proceeds of the particular property. The trustee manages or disposes of the trust property in his own name, for the benefit of the beneficiary or for a specific purpose at the will of the trustor. The main legal features of the trust can be summarized as follows: First, the obligation of trust is mandatory. The trustee can only fulfill the wishes and requirements of the principal according to the provisions of the trust documents and the law, and maximize the benefit of the beneficiaries. Second, the trust property is independent. Once the trust relationship is established, the trust property is separated from the property of the principal, trustee and beneficiary.
