中国房地产业宏观调控从未达到控制房价快速上涨的预期效果,因此应转变调控思路,研究建立房地产调控的长效机制。本文在检讨历次房地产调控手段失灵原因的基础上,提出长效机制的本质是制度改革。长效机制和法律有着内在的联系,在长效机制的建立过程中,法律应该起到重要作用。同时,探讨了如何建立房地产调控长效机制的具体法律路径。
China’s real estate macro-control has never reached the desired effect of controlling the rapid rise of house prices, so we should change the regulatory thinking and study the establishment of a long-term mechanism for real estate regulation and control. On the basis of reviewing the causes of failure of real estate regulation and control measures, this paper proposes that the essence of long-term mechanism is institutional reform. The long-term mechanism is intrinsically linked with the law. In the process of establishing the long-term mechanism, the law should play an important role. At the same time, it discusses how to establish a concrete legal path of long-term mechanism of real estate regulation.
