[案情]女职工在填写入职材料时,隐瞒了自己已婚的事实。上班不到一年,这名女职工怀孕了,用人单位以女职工提供虚假信息,有欺诈行为为由,撤退了她。女职工不服单位处理,起诉至法院。法院审理后判决公司辞退女工行为违法,应当支付经济赔偿金和绩效工资。2011年1月,28岁女子刘香应聘到一家设计公司担任财务会计,因为此前几次工作碰到的单位都要求女性未婚,这家单位虽然没有明确要求必须未婚,但是,为了稳妥起见,刘香在入职前后的《应聘表》与《员工登记表》均填写为未婚,隐瞒了自己已经结婚的事实。
[Case] Female employees hiding the fact that they were married when filling the entry materials. Less than a year after going to work, the female worker was pregnant. The employer retreated her on the grounds that female workers provided false information and cheated. Female staff members dissatisfied with unit handling, prosecution to the court. After the court ruled that the company dismissed the act of women as illegal, it should pay economic compensation and performance salary. In January 2011, a 28-year-old woman, Liu Xiang, was hired by a design firm as a financial accountant. Since the units she met in previous work required her to be unmarried, the unit did not explicitly require that she be unmarried. However, in order to be safe, Hong before and after entering the “job application” and “employee registration form” are filled out as unmarried, concealing the fact that they have been married.
