最高人民法院6月24日公布了由最高人民法院、最高人民检察院、公安部等联合制定的《关于办理死刑案件审查判断证据若干问题的规定》和《关于办理刑事案件排除非法证据若干问题的规定》,自2010年7月1日起施行。两“规定”对我国刑事证据制度作了一些补充和完善,是刑事司法领域的重大改革举措。且后者对解决刑讯逼供问题、减少冤假错案及贯彻宽严相济刑事政策等方面有重要意义。该规定首次明确了非法证据的证明责任,建立了非法证据排除的具体规则,弥补了刑诉法和相关司法解释对非法证据排除程序规定过于笼统、缺乏可操作性的缺陷,是我国程序法发展的一大进步。但在为之欢呼之余,也不能忽略其中的一些问题。

This stipulation for the first time clarified the burden of proof of illegal evidence and established specific rules for excluding illegal evidence to make up for the shortcomings of the provisions of exclusionary procedure of criminal law and relevant judicial interpretations that are too general and lack of operability. A big improvement. But while cheering for it, we can not overlook some of them.
