2011年颁布施行的刑法修正案(八)对现行《刑法》进行了较为全面的修改,是历次《刑法》修改中胆魄最大、力度最强、涉面最广的一次修改,无论在刑法理论界还是司法实践中都将会产生重大影响。而本案被作为修正案(八)实施后的首批指导性案例之一,对今后类似案件的审判工作具有极为重要的参考价值。本文分为三个部分,从基本案情展开,对案件的定罪量刑做出分析,最后进行了简单的评价。希望对司法实践有所帮助。
