传统法学教学过于追求客观性、确定性,这与培养创新型法律人才的目标不相契合。客观性、确定性的实现主要依赖演绎的思维范式,而逻辑演绎是自然科学的方法。法学不与自然科学分享本体论,因而在方法上也不应直接援引其方法论。法学主要关切理解,在诠释学看来,只要有理解,理解便会不同。因此,传统的真理观也并不适合法学。在法律问题上教师并没有独断真理,正确答案只在于师生的互动对话中。这是法学研究型教学的根基所在。
Traditional legal teaching is too obeying the objectivity and certainty, which does not fit with the goal of cultivating innovative legal talents. Objectivity and certainty depends mainly on the deductive thinking paradigm, and logical deduction is a natural science method. Law does not share the ontology with the natural sciences, so it should not be directly methodologically invoked. The main concern of law is to understand that in hermeneutics it seems that understanding and understanding will be different. Therefore, the traditional view of truth is not suitable for law. Teachers do not have arbitrary judgments on legal issues. The correct answer lies only in the interactive dialogue between teachers and students. This is the foundation of legal research teaching.
