“人肉搜索”已成为中国网民借助互联网集体力量解决生活、学习、工作问题的重要方式。作为一种新型的信息检索模式,“人肉搜索”在提供公共资讯、进行社会舆论监督、促进网络技术发展等方面都发挥了积极的作用。然而,“人肉搜索”所引发的言论自由权的边界、与公民隐私权冲突等问题,同样发人深省。对此,一方面应加强网络立法,从法律的层面为网络行为厘定边界;另一方面也应积极倡导行业自律,通过自身的行为准则促进网络行为的健康发展。 “Human flesh search ” has become an important way for Chinese netizens to solve the problems of life, study and work with the collective power of the Internet. As a new information retrieval model, Human Search has played an active role in providing public information, conducting public opinion supervision and promoting the development of network technology. However, the issue of the boundary of freedom of speech triggered by “human flesh search” is also thought-provoking as well as other issues such as the conflict of privacy rights of citizens. In this regard, on the one hand, we should strengthen the network legislation, from the legal level to determine the boundaries of network behavior; the other hand, should also actively promote industry self-regulation, through their own code of conduct to promote the healthy development of network behavior.
