近年来,银行业践行社会责任已经成为国内外的一个大趋势。在这一趋势中,“私政府立法”扮演了重要的角色,并呈现繁荣之态势。全球化的迅猛发展使国家所扮演的传统角色受到挑战,非国家行为主体的迅速崛起以及影响扩张成为银行践行社会责任的“私政府立法”的兴起背景。与传统的“国家间立法”不同,银行业践行社会责任方面的“私政府立法”有着独特的生成过程,“权力”、“利益”、“认同”等构成了它们的“合法性”来源。当然,银行业践行社会责任的“私政府立法”的兴起以及它们所具备的独特性,并不意味着它们将与“国家间立法”互相排斥。相反,银行业践行社会责任的“私政府立法”与“国家间立法”之间呈现出相互依赖的正相关之关系,两者的互动构成全球化背景下实现“全球治理”的必要方面。
