《中小企业促进法》的颁布在制度层面上形成了中小企业应获国家之手特别扶助的正当性。中小企业发展是社会工程 ,所需的法律资源是系统的 ,被誉为“自由企业大宪章”的反垄断法为其做出贡献自为题中之意。本文欲从反垄断法的有机构成———适用除外制度的角度 ,浅析反垄断法和中小企业保护的精神契合之处 ,论述应用反垄断法适用除外制度扶助中小企业发展的正当性和现实性 ,主张在反垄断法中加以体现。
The promulgation of the Law on Promotion of Small and Medium Enterprises formed at the institutional level the legitimacy that SMEs should receive special assistance from the state. The development of small and medium-sized enterprises is a social project. The legal resources required are systematic and the antitrust law, known as the “Magna Carta for Free Enterprises,” contributes to it.
