由于种种原因,战争罪被区分为国际性武装冲突中的和非国际性武装冲突中的战争罪,二者的构成要件以及具体罪名差异较为明显。从《成立国际刑事法院的罗马规约》的适用角度看,就目前的国际形势来说,国内武装冲突更为普遍,更具有现实意义。非国际性武装冲突中的战争罪的首要构成要件是国内武装冲突的存在,本文从主观和客观两个方面对这一要件进行辨析,并就其与国际性武装冲突的区别进行探讨。 For various reasons, war crimes are divided into war crimes in international armed conflicts and non-international armed conflicts. The differences between the two elements and the specific charges are obvious. Judging from the application of the Rome Statute establishing the International Criminal Court, the internal armed conflicts are more prevalent and relevant in the light of the current international situation. The most important element of war crimes in non-international armed conflicts is the existence of internal armed conflicts. This article analyzes this element from the subjective and objective aspects and discusses the differences between the two elements in the international armed conflicts.
