气候变化与国际贸易正在发生日益密切的关联,该关联甚至引发了两者之间的激烈冲突,这客观上需要建立不同国际规则或安排之间的相互协调机制。作为一种市场导向的气候变化政策,碳排放交易能通过“奖优罚劣”机制来激发企业的减排动力,并在全社会环境治理成本最小化的前提下实现温室气体的减排,故成为一种被广泛接受的减排措施。碳排放交易的特性使得其已经成为一种新型的国际贸易模式,但在传统国际贸易法的框架下,碳排放交易本身的法律属性尚不够清晰,而且与之相关的边境碳调节措施的合法性也正遭到普遍的质疑。为此,国际贸易法需从双边、区域和多边条约的层面进行适当的制度建设,世界贸易组织也应加强与相关国际组织或机构的合作,以实现气候变化政策与国际贸易法之间的“相互支持”。
