紧急仲裁员制度为当事人在仲裁庭组成前获得紧急救济提供了新路径,已得到重要国际仲裁机构的广泛采纳。然而,紧急仲裁员的决定因缺乏终局性难以通过现有的国际公约以及国内法的规定在国外得到认可或执行。在当前的法律体系下,紧急仲裁员的决定无法在中国得到执行。中国的《仲裁法》需要进行修订以适应国际商事仲裁实践的新发展。部分仲裁机构已率先采用紧急仲裁员制度,但其成效仍待检验。另外,仲裁机构应尽快完善仲裁规则中“紧急性”和“难以弥补的损害”等实体标准以便对紧急仲裁员作出具体指引。
The system of emergency arbitrators provides a new path for parties to obtain emergency relief before the formation of the arbitral tribunal and has been widely adopted by major international arbitration bodies. However, due to the lack of finality, the decision of the emergency arbitrator can not be recognized or enforced abroad by existing international conventions and the provisions of domestic law. Under the current legal system, the decision of the emergency arbitrator can not be enforced in China. China’s “Arbitration Law” needs to be revised to meet the new development of international commercial arbitration practice. Some arbitration agencies have taken the lead in adopting the system of emergency arbitrators, but their effectiveness remains to be tested. In addition, the arbitration body should expeditiously refine the substantive criteria of the arbitration rules such as “emergency” and “irreparable damage” in order to give specific guidance to the emergency arbitrator.
