在美国诉欧盟农产品和食品地理标志及商标保护案中,WTO争端解决机构专家组认定欧盟2081/92条例关于地理标志的申请和异议程序不符合《TRIPS协定》之国民待遇原则,但在审查机构和标签要求方面没有支持美国的主张。为执行争端解决机构的裁决,欧盟制定了510/2006条例。之后,一些欧盟境外的地理标志产品根据510/2006条例相继获得注册。分析欧盟境外地理标志产品在欧盟的注册情况,不仅有助于完善中国地理标志保护相关立法,更有助于中国确立在地理标志保护国际谈判中的态度和主张。
In the United States v. European Union for the Protection of the Geographical Indications and Trademarks of Agricultural Products and Foodstuffs, the WTO Panel of Experts on Dispute Settlement concluded that the application and opposition procedures of the EU’s 2081/92 Regulations on geographical indications do not comply with the national treatment principle of the TRIPS Agreement. However, And the labeling requirements did not support the U.S. claim. In order to implement the ruling of the Dispute Settlement Body, the EU has enacted Regulation 510/2006. Later, some GI products outside the EU were registered under the regulations of 510/2006. Analysis of the EU’s registration of geographical indication products outside the EU will not only help improve the relevant legislation on the protection of geographical indications in China, but also help China establish its attitude and proposition in the international negotiations on the protection of geographical indications.
