公务员由于故意或重大过失造成相对人合法权益损害的,是否应由公务员个人承担责任,这似乎是被学界忽略的问题。在实践中,大部分行政赔偿案件都是由国家承担赔偿责任,公务员基本上不承担赔偿责任。这样做无法切实保护相对人的合法权益,也不符合职责统一的原则。借鉴其他国家相关制度和做法,结合我国实际情况,推进依法行政,应当要求有重大过失的公务员个人承担赔偿责任。
Whether civil servants should be held accountable by civil servants as a result of intentional or gross negligence resulting in damage to their legitimate rights and interests seems to have been overlooked by academics. In practice, most of the cases of administrative compensation are borne by the state for compensation, civil servants basically do not assume liability for compensation. This can not effectively protect the legitimate rights and interests of the relatives, nor does it conform to the principle of unification of duties. Drawing on the relevant systems and practices in other countries and in accordance with the actual conditions in our country, we should promote the administration according to law and should require individual civil servants who have gross negligence to bear the liability for compensation.
