中国法治民族叙事,遭遇到显见的“诗性断裂”;它既是古今之间的断裂,也是普世主义一特殊主义的一种本能抵抗——而其中更被追加着西方现代价值观之危机,即价值虚无主义、相对主义等现代性处境的复杂的断裂后之难题——也共时性地追加到中国法治进程之中。而作为对于价值虚无危机之思考,试图以存在主义之法哲学对抗价值叙事之空无,在中国的大地法理论构想中是否可行?中国传统之礼制,是否乃一种大地法则?而传统正统之天人秩序,在本文中既被认为是一种根源于本土大地之礼俗,又因儒家思想的中庸与中和的人世方法论,而与现代自由主义式之自生自发秩序,保持着一种张力并持存——即儒家之宇宙观一方法论,能通行于现时,亦能共时于不同的时代精神;且通过本文之考察,自由经济的自生自发秩序——虽其从理论构建之出发点上看,乃从批判古希腊语词,nomos人手,其试图提出一种新的自然与理性之间自由演进的秩序观,但其事实上仍属于自由主义经济理性的一种现代式构建,而非出于古希腊意义上的大地法则与本源精神。
