案情简介某大酒店将厨房发包给厨师长(自然人),双方订立承包合同,合同中约定:大酒店每月支付给厨师长包厨费,厨房工作人员技能、数量、工资标准等均由厨师长自行招用确定。职工陈某于2010年2月被厨师长招用为勤杂工。2011年6月,厨师长以职工陈某工作表现差等理由将其辞退。陈某一纸诉状将大酒店告上劳动仲裁庭,要求裁决大酒店:支付未订立书面劳动合同二倍工资;缴纳劳动关系存续期间各项社会保险费;支付违法终止劳动关系赔偿金。仲裁庭在调查基础上认定如下事实:大酒店将厨房发包给厨师长王某,双方订立承包合同;大酒店不对厨房员
