针对业主工程款支付担保的实践情况,剖析了其在预防房地产烂尾项目中的作用以及存在的局限,并进一步提出了提高保函保额、将在建工程所有权纳入反担保条款以及设立工程担保产业基金,为担保公司提供资金支持等创新举措,以期为更好地解决我国的烂尾项目问题提供参考。
In view of the practice of paying the guarantee for the owner’s project payment, the paper analyzes its function and limitation in the prevention of real estate unqualified project, and further puts forward some suggestions such as increasing the guarantee amount of the guarantee, including the ownership of the construction in progress in the counter-guarantee clause and setting up engineering guarantee industry Funds, providing financial support for guarantee companies and other innovative measures, with a view to providing a reference for better solving the problems of our country’s unfinished projects.
