公安交管部门是具体实施机动车限行政策的行政机关。常态化的限行措施超越了《道路交通安全法》对公安交管部门的执法授权,需要以政府通告的形式向社会公布。政府通告是公安交管部门的执法依据、管理依据,但不能成为公安交管部门的处罚依据。从道路交通管理的特点来看,公安交管部门主要通过现场管理和树立禁令标志两种方式实施机动车限行,但这两种措施都有一定的局限性,需要公安交管部门认真对待。
The public security department is the administrative organ that specifically implements the policy of limiting the number of motor vehicles.
