工资是劳动者及其家庭成员生活的主要来源,也是影响劳动关系和谐稳定的重要因素。它关系到社会财富的分配与创造,涉及到广大劳动者的切身利益。加强对劳动者工资收入的法律保障,对于保护劳动者的合法权益,协调劳动关系,维护改革、发展、稳定的大局具有重要的意义。目前劳动者工资收人的法律保障主要表现在以下几方面。一、最低工资的支付及法律保障。最低工资是指劳动者在法定工作时间内提供了正常劳动的前提下,其所在单位应当支付的最低劳动报酬。《劳动法》规定,国家实行最低工资保障制度,用人单位支付劳动者的工资不得低于当地最低工资标准。也就是说,只要劳动者在法定工作时间内提供了正常劳动,那么就应该获得不低于当地最低工资标准的劳动报酬。

At present, the legal protection of workers' wages and salaries is mainly manifested in the following aspects. First, the minimum wage payment and legal protection. The minimum wage refers to the laborer's minimum labor remuneration that his unit should pay under the premise of providing normal labor within the legal working hours. The “Labor Law” stipulates that the state shall impose the minimum wage guarantee system and the wage paid by the employing units to the workers shall not be lower than the local minimum wage. In other words, as long as the worker provides normal work within the legal working hours, he / she should receive the remuneration for work not less than the local minimum wage.
