根据国际经验,追溯是保障蔬菜质量安全的重要手段。欧盟、美国、日本均建立了相对完善的追溯法律体系,并明文规定了追溯理念、主体责任、监管机构、惩罚机制等内容。我国蔬菜追溯目前尚未提升到法律层面,与追溯有关的生产记录制度、包装标识制度、进货查验记录制度、销售凭证制度也仅仅在个别部门规章中有所提及。因此,从蔬菜追溯法律角度,我国急需完善《食品安全法》,建立完整的追溯法律体系,制定无缝衔接的追溯制度。
According to international experience, traceability is an important means to ensure the quality and safety of vegetables. The EU, the United States and Japan all have established a relatively complete retrospective legal system and clearly stipulated the concepts of retrospectiveness, principal responsibility, regulatory agencies and penalties. The traceability of vegetables in our country has not yet been promoted to the legal level. The system of record of production, packaging identification system, purchase inspection record system and sales voucher system related to retrospective are also mentioned in the regulations of individual departments only. Therefore, from the perspective of vegetable traceability law, China urgently needs to improve the Food Safety Law, establish a complete retrospective legal system, and establish a seamless system of traceability.
