检察官业绩评价是司法责任制改革下推进检察官职业化的有力手段,我国目前没有针对检察官司法属性和职业定位的业绩评价形式,在套用行政公务员管理模式中出现科层主义、平均主义和形式主义三大制约司法责任制改革的因素。法、德、日等国检察官业绩评价的经验,体现出检察官独任、专属、精英之特点,为符合司法规律之共性。科学的检察官业绩评价机制应当以纯化、量化、细化为着眼点,从评价内容、指标确定、考评主体、结果运用等四个方面来进行优化设计。
Procurator performance evaluation is a powerful means to promote the professionalization of prosecutors under the reform of judicial responsibility system. At present, there is no performance evaluation model for the prosecutor’s judicial attribute and career orientation in our country. In the application of administrative civil servant management model, there is bureaucratic, egalitarian and The Three Factors Restricting the Reform of Judicial Responsibility System in Formalism. France, Germany, Japan and other countries prosecutors performance evaluation experience, reflecting the prosecutors alone, exclusive, elite characteristics, in order to meet the common law of justice. Scientific procuratorial performance appraisal mechanism should be based on purification, quantification and refinement, and optimize design from the aspects of evaluation contents, indicators, subject of appraisal and application of results.
