在考察美国判例、学说在客户名单保护上的一些基本观点的基础上,介绍了客户名单的构成要件、可转让性等问题。对于如何解决好隐私权的保护与客户名单的财产性这一矛盾的问题,在借鉴美国经验的基础上,通过比较分析得出了结论,可供我国商业秘密立法之参考。
On the basis of examining some basic views on the protection of customer list in American precedents and doctrines, the paper introduces the elements of customer list, transferability and other issues. On the basis of drawing lessons from the experience of the United States on the contradiction between the protection of the right of privacy and the property of the client list, this paper draws a conclusion through comparative analysis, which can be used as a reference for the legislation of commercial secrets in our country.
