职务犯罪的侦查阶段是查办职务犯罪诉讼程序中惩治犯罪与保障人权两种利益最容易发生冲突的阶段。随着我国政府签署《公民权利和政治权利国际公约》和我国十届人大二次会议通过的《宪法修正案》把“尊重和保障人权”的规定写入宪法,如何保障职务犯罪嫌疑人的人权问题正日益引起法学界和司法实务部门的关注。1996年我国《刑事诉讼法》虽然在保障犯罪嫌疑人人权问题有了很大改进,但是相对于国际标准仍存在着诸多不足和差距。这就需要对保障职务犯罪嫌疑人人权存在的问题和困惑进行理性分析和思考,并通过赋予其一系列保障性权利和限制检察机关的追诉权及提升检察官素质等来加以完善。
The investigation stage of job-related crime is the stage where the two interests of punishing crime and safeguarding human rights are most likely to conflict during the process of investigating and handling job-related crimes. With the signing of the “International Covenant on Civil and Political Rights” and the “Constitutional Amendment” passed at the Second Session of the Tenth National People’s Congress, our government has promulgated the “Respect and Guarantee of Human Rights” The issue of human rights is increasingly arousing the attention of jurisprudence and judicial substantive departments. Although China’s “Criminal Procedure Law” has greatly improved the protection of the human rights of criminal suspects in 1996, there are still many deficiencies and gaps in comparison with international standards. This requires a rational analysis and reflection on the problems and puzzles in safeguarding the human rights of job-suspects, and it is also to be perfected by giving it a series of safeguard rights and restricting the prosecutorial power of prosecution and improving the quality of prosecutors.
