阿云之狱的定性有法律事件和政治事件之争,解决这一争论的关键在于律文的解读。从王安石与司马光等人的辩论中,我们能够观察到古人高超的法律解释技术:文义解释、体系解释、社会解释以及价值解释等多种解释方法被应用。双方的立论都以阐明律义为起点,但从对立法者原意的解读来说,王安石等人的观点存在不少逻辑漏洞,他们的解读带有强烈的政治色彩。不过由于宋神宗对王安石的青睐,阿云之狱从法律问题内在地转化成立政治问题,王安石等人胜出。这是王安石变法与专制权力内在亲和力的必然表现,阿云之狱不过是王安石变法道路上的权力插曲而已。可以说阿云之狱以法律问题开始,以政治解决结束。
A cloud of the prison of the qualitative law and political events of the dispute, the key to solve this debate is the interpretation of the law. From the debate between Wang Anshi and Sima Guang et al., We can observe that the supernatural techniques of interpretation of the ancients are applied in various interpretations such as the semantic interpretation, the system interpretation, the social interpretation, and the value interpretation. Both of the arguments are based on elucidating the meaning of righteousness. However, from the interpretation of the original intention of the legislators, there are many logical loopholes in Wang Anshi’s view and their interpretation is strongly political. However, due to the favor of Wang Anshi by Song Shenzong, Ah Yun’s prison was intrinsically transformed from a legal issue into a political issue, and Wang Anshi and others won. This is the inevitable manifestation of Wang An-shi’s transformation and the inherent affinity of authoritarian power. A-yin’s prison is merely an episode of power on the path of Wang Anshi’s change. It can be said that Aun’s prison started with legal issues and ended with a political solution.
