武装冲突中学校面临着遭到严重破坏的严峻现实。对学校的保护是战争法人道价值的重要表现,然而战争法体系下学校保护的规范严重贫乏,从最早涉及学校保护的法律文件到1977年的日内瓦《第一附加议定书》,都没有赋予学校直接、明晰和独立的保护权利。立足于学校自身的教育公益属性以及对社会的重要价值,战争法规范需重新建构一种全新的学校建筑的保护制度,周全学校受保护的范围,明确学校在战场上普遍的,一致的辨识标志,赋予其独立的保护地位使其免受任何军事攻击。
