完善法律规制对保障我国城市黑臭河道治理具有重要意义。根据“水十条”规定,在法律层面应当健全配套法律法规、细化地方政府的责任模式、创新对排污单位的管理手段、完善社会监督机制。而实践中仍存在现有立法针对性差、政府间责任边界模糊、对排污主体的调控乏力、社会参与监管的方式虚化等缺憾,迫切需要通过修订相关立法、完善河长制、改进排污权有偿使用和交易制度、保障公众参与原则,来加强我国城市黑臭河道治理中的法律保障力度,贯彻落实“水十条”。
