在建船舶抵押制度探讨——兼论《物权法》引入之浮动抵押

现行我国在建船舶抵押制度发展滞后的主要原因在于我国传统担保物权体系的不足。本文突破传统担保物权理念,将我国《物权法》引人之浮动抵押和我国在建船舶抵押制度相结合,首先通过对两者的分析,指出浮动抵押理论必须且能够应用于在建船舶抵押中,并对其如何应用(包括结晶和接管人)提出了设想,对其应用中会出现的在建船舶抵押主体和效力方面的问题提出了相应的解决建议。 The main reason for the current development of ship mortgage under construction in China is lagging behind lies in the lack of traditional security system in China. This article breaks through the concept of traditional security rights, combines the floating mortgage introduced by the Property Law of our country with the mortgage system under construction in our country. First, through the analysis of the two, it points out that the floating mortgage theory must be applied to mortgage under construction , And put forward the idea of ​​how to apply it (including crystallization and receiver), and put forward corresponding solutions to the problems of the subject and validity of the ship under construction which will appear in the application.
