司法三段论大前提的建构是一个相当复杂的过程,并且其在整个法律适用中占有十分重要的地位,因此研究大前提建构的具体方法也就具有重要意义。本文笔者从事实与规范之间的对应关系角度,对大前提构建的具体方法分五种情况行了分析,以期能实现事实与规范之间的同一性,使其形成耦合,从而保证法律规范适用的正确性,最终实现法律的公正价值。
