当前世界范围的气候变化需要全球性的治理规则,在尊重传统国际气候变化规则的同时,发达国家也应当在气候融资和资本输出方面作出贡献以增加减缓气候变化所需要的技术和资金。但是这种气候友好型投资的实施有时会导致国家承担的投资保护义务和气候变化义务发生冲突,故需要制定合理平衡投资者和东道国权益保护的国际投资规则。国际投资协定相关条款可以根据气候变化的情况作出某些修改,譬如加强缔约国的管制权、增加例外条款以及强化投资的可持续发展目标等,国际投资仲裁庭也应当从保护全球公共利益的角度出发,合理处理投资者保护和气候变化应对措施之间的关系,从而有助于全球气候治理的进一步发展。
Current global climate change requires global governance rules. While respecting the traditional rules of international climate change, developed countries should also contribute to climate finance and capital output to increase the technology and capital needed to mitigate climate change. However, the implementation of this climate-friendly investment sometimes leads to conflicts between the state’s obligations on investment protection and those on climate change. Therefore, it is necessary to formulate international investment rules that rationally balance the interests of investors and host countries. The relevant provisions of IIAs can make some changes according to the climate change, such as strengthening the control power of contracting states, adding exceptional provisions and strengthening the sustainable development goals of investment, etc. The international investment arbitration tribunal should also consider from the perspective of protecting the global public interest , And properly handle the relationship between investor protection and climate change response measures so as to contribute to the further development of global climate governance.
